This bill adds a new section to Idaho law to establish provisions regarding petitions for waivers of or variances from occupational licensing requirements or practices. The bill allows any person to petition a licensing authority for a waiver or variance if the application of the licensing requirement or practice is unreasonable and imposes undue hardship, if the petitioner proposes an alternative that would provide substantially equal protection, or if the waiver or variance would test an innovative practice. The licensing authority must either deny the petition or grant the waiver or variance, and must take action within 28 days (or by the first regularly scheduled meeting if the authority has a multi-member board). The bill also requires the licensing authority to consider changes that would allow all similarly situated persons to derive the same benefits as the petitioner. The bill takes effect on July 1, 2024.
