This bill, the Used Car Safety Recall Repair Act, prohibits auto dealers from selling, leasing, or loaning used vehicles with open safety recalls to consumers. It defines a "used motor vehicle" as one that has been previously purchased for purposes other than resale. The bill also requires manufacturers to reimburse dealers for holding on to used vehicles with open recalls until the recall has been remedied, at a rate determined by the Secretary of Transportation. There are some exceptions, such as when the recall information was not available to the dealer at the time of the transaction or the used vehicle is being sold at wholesale. The bill will take effect one year after it is enacted.
