This bill prohibits the sale of playground surfacing materials that contain per- and polyfluoroalkyl substances (PFAS), polycyclic aromatic hydrocarbons (PAHs), or more than 90 parts per million of lead, starting on January 1, 2026. Manufacturers of these materials must provide a certificate of compliance to distributors and retailers, and penalties are established for violations. The bill also requires manufacturers to provide test results or notify retailers if the department has reason to believe the materials are not compliant. Retailers acting in good faith based on the manufacturer's certificate are not liable for violations.
