This bill allows the commissioner to grant variances to the licensed capacity limit for child care centers if the center's indoor space is within 100 square feet of what would be required for maximum enrollment based on the center's number and qualifications of staff. The bill amends the existing law on variances to allow the commissioner to consider these types of capacity variances, in addition to the existing provisions related to variances for staff qualification requirements that do not affect the health and safety of children.
