This bill amends the existing laws on the unlawful distribution of controlled substances and creates a new offense for the unlawful distribution of marijuana. Specifically, the bill: 1. Defines key terms related to sentencing, including "continuum of punishments," "intermediate punishment," and "violent offender." 2. Amends the definition of "unlawful distribution of controlled substances" to distinguish between selling and furnishing/delivering controlled substances (excluding marijuana). 3. Establishes a new offense for the "unlawful distribution of marijuana" as a Class B felony. 4. Retains the existing penalty enhancement of a 5-year incarceration for unlawful distribution of controlled substances within a certain distance of schools, colleges, universities, or public housing projects. 5. Sets the effective date of the act as October 1, 2024.
