This bill requires secondhand dealers, defined as anyone who buys, sells, or trades used phones and wireless devices (excluding mobile service providers and those licensed for portable electronics insurance, but including automated kiosks), to document each transaction by recording the device's description and a unique identifier like the IMEI or serial number, and to obtain a signed statement from the seller confirming their age, the accuracy of their identification, and their legal ownership of the device. Sellers are prohibited from providing false information, and dealers cannot knowingly acquire devices obtained through fraudulent means. Dealers must also verify the seller's identity using two forms of identification, at least one of which must be a government-issued photo ID, or take a photograph of the seller and record specific personal details if a photo ID isn't available, with an exception for automated kiosks that require government-issued ID. Furthermore, dealers are forbidden from altering or purchasing devices with altered or removed identifying marks, must keep transaction records for one year, and make them available to law enforcement and the Director of the Division of Consumer Affairs, while also being restricted from selling or sharing seller information without consent. Violations can result in escalating civil penalties, and the Director of the Division of Consumer Affairs is empowered to create rules to implement these provisions.
