This bill requires the chief administrator, by November 1, 2024, to check the federal Drug and Alcohol Clearinghouse for information on all applicants seeking a commercial driver's license (CDL) or commercial learner's permit (CLP), including renewals, transfers, and upgrades, and for those seeking a hazardous materials endorsement. A CDL or CLP will not be issued, renewed, transferred, or upgraded if the applicant is prohibited from operating a commercial motor vehicle due to a violation found in the clearinghouse, and existing CDLs or CLPs will be downgraded in such cases. The bill also mandates that the chief administrator will downgrade a CDL or CLP if the clearinghouse indicates a driver is prohibited from operating a commercial motor vehicle, and this downgrade must be recorded within 60 days, with reinstatement possible upon notification from the Federal Motor Carrier Safety Administration that the driver has completed the return-to-duty process or if an erroneous entry is corrected. Furthermore, by applying for a CDL or CLP, drivers are considered to have consented to the release of their information from the Drug and Alcohol Clearinghouse to the chief administrator.
