Bill Summary

AN ACT To amend the Export Control Reform Act of 2018 to provide for control of remote access of items, and for other purposes.

AI Summary

This bill amends the Export Control Reform Act of 2018 to provide for the control of "remote access" to items subject to U.S. jurisdiction, regardless of the physical location of the item. "Remote access" is defined as access by a foreign person to a U.S.-controlled item through a network connection, such as the internet or cloud computing, to use the functions of the item if that use could pose a serious risk to U.S. national security or foreign policy. The bill authorizes the President to regulate such remote access, including for items that could enable the development of weapons of mass destruction, offensive cyber operations, or the evasion of human control over automated systems. The bill also expands export control requirements to cover remote access in addition to physical exports, reexports, and in-country transfers.
