AN ACT to amend the civil service law, in relation to unlawful strikes by public employees

This bill amends the civil service law to: 1. Define "unlawful strike" as any strike not authorized by the law. 2. Require certain public transportation authorities (the Metropolitan Transportation Authority, New York City Transit Authority, Triborough Bridge and Tunnel Authority, and several regional transportation authorities) to make every reasonable effort to reach agreements with employees on salaries, wages, hours, and other terms and conditions of employment, and to settle all disputes to avoid interruptions in government operations. 3. Establish a process for the public employment relations board to assist in resolving disputes between these public transportation authorities and their employees, including mandatory mediation and, if necessary, binding arbitration. 4. Prohibit public employees and employee organizations from engaging in or causing "unlawful strikes," and provide penalties for violations. 5. Require public employers to report on the circumstances, efforts to terminate, and individual responsibilities related to any "unlawful strike." 6. Allow public employers and employee organizations to seek injunctive relief from the courts to preserve the status quo when there is reasonable cause to believe a violation of the dispute resolution process has occurred.
