This bill establishes the crimes of home invasion burglary and residential burglary. Home invasion burglary is a first-degree crime where the person, without license or privilege, enters or remains in a residential dwelling and in the course of committing the offense, purposely, knowingly, or recklessly inflicts, attempts to inflict, or threatens to inflict bodily injury, or is armed with or displays what appear to be explosives or a deadly weapon. Residential burglary is a second-degree crime where the person, with purpose to commit an offense, enters or surreptitiously remains in a residential dwelling without being licensed or privileged to do so. The bill also amends various provisions related to juvenile waiver, burglary definitions, sentencing, and extended terms to incorporate these new offenses.
