This bill establishes a process for "rehabilitative release" for certain incarcerated individuals in New Jersey. Generally, the Commissioner of Corrections must issue a Certificate of Eligibility for Rehabilitative Release to individuals who have served at least 20 years in custody and are at least 60 years old. However, this certificate cannot be awarded to those convicted of murder, aggravated sexual assault, or certain repetitive and compulsive offenses. Upon receiving this certificate, an individual can petition the court for a sentence modification, reduction, or suspension. The court must grant this petition if it finds, by clear and convincing evidence, that the person is not a danger, is ready for reentry, and that justice warrants the modification. The bill also outlines factors the court must consider, such as the individual's age, rehabilitation efforts, disciplinary record, victim impact statements, and reentry plans. If a sentence is modified, the individual will also be subject to a five-year term of parole supervision. The bill also amends existing law regarding the preparation of reports for parole consideration to include references to this new rehabilitative release process.
