AN ACT to amend the tax law, in relation to establishing the USDA construction tax credit

This bill establishes the USDA construction tax credit, which allows taxpayers to claim a credit of up to 15% of the difference between the total cost to build and the final sale price of any newly constructed property that is sold to a person or persons who finance the purchase with a USDA mortgage. A USDA mortgage refers to any mortgage loan subject to the provisions of Title 7 CFR Part 3550, Title 7 CFR Part 3555, or Title 7 CFR Part 3560. The commissioner of the department of taxation and finance is required to promulgate rules and regulations necessary to implement this act, which takes effect immediately.
