This bill amends Section 35 of the existing law (P.L.2008, c.46) regarding the imposition of a fee on non-residential development. The key provisions are: 1. Municipalities authorized to retain and expend non-residential development fees must provide the Department of Community Affairs (DCA) with a detailed accounting of all such fees collected and expended since the inception of their authorization, within 180 days of the enactment of this bill. 2. Thereafter, these municipalities must provide the DCA with a detailed accounting of all non-residential development fees collected and expended in the previous year, by February 15 annually. 3. The bill applies retroactively to authorize and validate the provision of the detailed accounting by any municipality, as required in the new provision, if provided to the DCA on or before 180 days following the enactment of this bill.
