This bill, the Student Veteran Debt Relief Act of 2024, amends Title 38 of the United States Code to modify the requirements for the Department of Veterans Affairs (VA) to recover overpayments made to eligible veterans or persons related to their educational assistance benefits. Specifically, the bill states that the overpayment will not be the liability of the veteran, eligible person, or educational institution if they can demonstrate that the VA made an error or the Department of Defense provided incorrect information regarding the eligibility for the educational assistance. Additionally, the bill requires the VA to review the liability for hardship waivers and establish payment plans if the overpayment is likely to prevent the veteran or eligible person from continuing their education. The bill also limits the VA's ability to recover overpayments to those that occurred and were identified on or after January 5, 2021, and were identified and the educational institution notified within 10 years of the overpayment.
