This bill amends Michigan's penal code by enhancing penalties for the crime of embezzlement from vulnerable adults, both during their lifetime and after their death through the misuse of their estate. It specifies that a person who continues to violate this law after the vulnerable adult's death by using or obtaining the vulnerable adult's money or property from their estate can be prosecuted for acts committed both during the vulnerable adult's life and after their death. The bill also allows for the aggregation of the value of money or property obtained through separate incidents over a 12-month period, or if the violation was committed against a vulnerable adult during their lifetime and continued after their death. The penalties range from up to 93 days in jail or a fine for thefts under $200 to up to 20 years in prison or a $50,000 fine for thefts of $100,000 or more, with enhanced penalties for repeat offenders.
