This bill, the Separation of Powers Restoration Act, amends Title 5 of the United States Code to change the judicial review of agency interpretations of statutory and regulatory provisions. The key changes are: 1) the reviewing court must decide all relevant questions of law, including the interpretation of constitutional and statutory provisions, and cannot defer to the agency's interpretation; 2) the court cannot interpret ambiguities or gaps in statutes or regulations as implicit delegations of legislative rulemaking authority to the agency; and 3) this new standard of judicial review applies broadly to any action for judicial review of agency action, unless a law specifically exempts the action from this section.
