This bill amends the Unfair Trade Practices and Consumer Protection Law by further defining and regulating certain marketing practices. It adds definitions for "environmental marketing claim," "net zero claim," and "paltering" (using a truthful statement to create a false, deceptive, or misleading impression). The bill also expands the definition of "unfair methods of competition" and "unfair or deceptive acts or practices" to include making untruthful, deceptive, or misleading environmental marketing claims or net zero claims. Importantly, the bill allows private actions to be brought for such violations without requiring the plaintiff to demonstrate any ascertainable loss, providing an additional enforcement mechanism. The bill takes effect 60 days after enactment.
