This bill authorizes additional courts, beyond just the juvenile court, to issue emergency ex parte orders for the protection of juveniles in cases where there is evidence of abuse or neglect. The bill provides a process for the court to remove the child from their parent or legal custodian and place them either with a relative or in the temporary protective custody of the local county Department of Human Resources (the "department"). The department is then required to proceed with its duties under the state's child abuse and neglect laws. The emergency order remains in effect until the juvenile court holds a hearing and either ratifies the order or enters its own order.
