This bill amends the Pennsylvania Consolidated Statutes to further define the offense of stalking. The key changes are: 1) removing the requirement that the stalking behavior demonstrate an intent to place the victim in reasonable fear of bodily injury or cause substantial emotional distress, and instead requiring that the stalker act knowingly or recklessly to place the victim in reasonable fear of bodily injury or cause substantial emotional distress; and 2) removing the requirement that the repeated communications demonstrate an intent to place the victim in reasonable fear or cause substantial emotional distress, and instead requiring the stalker to act knowingly or recklessly to place the victim in reasonable fear or cause substantial emotional distress through the communications. The bill takes effect 60 days after enactment.
