This bill allows a court to take additional time when making a pretrial detention determination in cases where the charged crime or offense involved a firearm. Under current law, a court is required to make a pretrial release determination for an eligible defendant without unnecessary delay, but no later than 48 hours after the defendant's commitment to jail. Under the bill, cases involving crimes or offenses related to the use or possession of a firearm are exempted from the 48 hour requirement.
