AN ACT ENTITLED: “AN ACT GENERALLY REVISING RESIDENT PREFERENCES FOR PUBLIC CONTRACTS AND CONTRACT TERM LIMITS; PROVIDING THAT THE DEPARTMENT OF ADMINISTRATION IS RESPONSIBLE FOR DETERMINING THE RESIDENCY OF CONTRACTORS WHO BID ON PUBLIC CONTRACTS FOR CONSTRUCTION, REPAIR, AND PUBLIC WORKS OR PUBLIC CONTRACTS FOR THE PURCHASE OF GOODS; ALLOWING CONTRACTORS TO SUPPORT PREFERENCE CLAIMS BY AFFIDAVIT OR DECLARATION; ALLOWING CONTRACTORS FOR MOST SUPPLIES AND SERVICES TO BE EXTED TO A MAXIMUM OF 10 YEARS; AND AMING SECTIONS 18-1-106, 18-1-113, 18-4-313, AND 23-1-102, MCA.”

AI Summary

This bill makes several key changes to Montana's laws regarding public contracts and residency preferences. The Department of Administration will now be responsible for determining the residency status of contractors bidding on public contracts for construction, repair, public works, and goods purchases. Contractors can now support their residency preference claims using either an affidavit or a declaration, providing more flexibility in documentation. The bill extends the maximum contract term for most supplies and services from 7 to 10 years, allowing for longer-term agreements. If a contractor submits a false affidavit or declaration about their residency status, they will be disqualified from bidding on public contracts for 5 years. The bill also makes technical changes to various sections of Montana Code, such as removing references to the "department of labor and industry" and updating cross-references between different sections of law. These modifications aim to streamline the process of determining contractor residency, provide more contract flexibility, and maintain accountability in public contracting processes.
