AI Summary

This bill establishes a comprehensive framework for out-of-state healthcare providers to provide telehealth and telemedicine services in Montana, creating a standardized registration process for professionals not originally licensed in the state. The legislation defines key terms like "telehealth," "telemedicine," "asynchronous" and "synchronous" communication, and "remote patient monitoring," and outlines specific registration requirements for out-of-state providers, including having an active, unencumbered license from another state and no significant disciplinary history in the past five years. Healthcare providers must register with the appropriate state board or department, pay a registration fee comparable to in-state licensure, and notify the state of any disciplinary actions or license restrictions within five business days. The bill provides several exemptions to the registration requirement, such as emergency medical care, consultations with in-state providers, and limited telehealth encounters. Additionally, the legislation prohibits in-person appearance requirements for applicants, allows electronic information submission, establishes that telehealth services are legally considered to occur at the patient's location, and grants the state department authority to adopt implementation rules and take disciplinary action against providers who violate the regulations.
