Bill Summary

AN ACT GENERALLY REVISING CAMPAIGN FINANCE LAWS; PROVIDING LIMITATIONS THAT ONLY A LIMITED LIABILITY COMPANY AND PARTNERSHIP THAT IS TAXED AS A SOLE PROPRIETORSHIP OR A PARTNERSHIP, OR A PARTNERSHIP TAXED AS A PARTNERSHIP, MAY MAKE CONTRIBUTIONS TO A CANDIDATE AND THAT THE CONTRIBUTIONS MUST BE REPORTED UNDER THE NAME OF THE MEMBER OR PARTNER MAKING THE CONTRIBUTION; AND PROHIBITING AN INDIVIDUAL CONTRIBUTION SEPARATE FROM THE CONTRIBUTION MADE BY THE MEMBER OR PARTNER OF THE LIMITED LIABILITY COMPANY OR PARTNERSHIP CLARIFYING CONTRIBUTION LIMITS.”

AI Summary

This bill revises campaign finance regulations by restricting and clarifying which business entities can make political campaign contributions. Specifically, only limited liability companies (LLCs) and partnerships that are classified and taxed as sole proprietorships or partnerships for federal tax purposes will be allowed to contribute to candidate campaigns. Contributions from LLCs or partnerships taxed as C or S corporations will be prohibited. Any contribution from an eligible LLC or partnership must be reported under the name of the specific member or partner making the contribution, in compliance with existing disclosure requirements. Furthermore, the bill stipulates that the member or partner reported as making a contribution cannot make an additional individual contribution to the same candidate, and they remain subject to individual contribution limitations established in existing campaign finance law. The purpose of these changes appears to be increasing transparency in campaign financing by ensuring that contributions are clearly attributed to individual business owners and preventing potential circumvention of contribution limits.
