AI Summary

This bill revises tenant moveout laws in Montana by clarifying several key provisions related to security deposits and property damage. It defines "normal wear" to include small nail holes, scuffs and chips on painted walls, and visible wear in high-traffic areas of a residence. The bill limits landlords' ability to deduct cleaning charges from security deposits by stipulating that labor charges cannot exceed the prevailing rates for a professional cleaner, and prohibits deductions for painting or recarpeting after a tenancy of two or more years. The legislation also shortens the timeline for landlords to provide tenants with a detailed list of damages or refund from 30 to 21 days, and requires landlords to include a copy of a professional cleaner's bill if cleaning charges are assessed. If a landlord wrongfully withholds a security deposit, they may be liable for damages and potentially required to pay the tenant's attorney fees. The changes aim to provide more clarity and protection for tenants during the moveout process by establishing more precise guidelines for security deposit handling and defining reasonable wear and tear.
