This bill creates a new criminal offense of trespass on or near school or day-care center property in Texas. Specifically, a person commits this offense if they enter or remain on school or day-care center property (including the property itself or public property within 250 feet of it) without a legitimate reason, such as having a student at the school or day-care center or having written permission from an authorized representative. If an administrator, educator, or security personnel asks the person to leave and they fail to do so, they can be charged with a Class A misdemeanor. The bill defines key terms like "school" (including private and public elementary or secondary schools), "day-care center" (as defined in the Human Resources Code), and "school or day-care center property" (which includes all owned or leased land and buildings, as well as grounds where school-sponsored activities are taking place). If the trespassing behavior also constitutes another criminal offense, the person may be prosecuted under this new law, the other law, or both. The bill is set to take effect on September 1, 2025.
