This bill amends the Local Government Code to provide specific provisions for county and municipal jurisdiction over land subdivision in certain counties with a population over 370,000 containing more than six municipalities under 2,000 people. The bill introduces two new sections that allow counties to unilaterally amend existing jurisdiction agreements for "qualified parcels" - which are land parcels over 10 acres proposed for residential subdivision with lots smaller than half an acre. For such parcels, a county's commissioners court can transfer exclusive jurisdiction for subdivision platting by following a consultation and notice process with the municipality. Additionally, the bill establishes an arbitration mechanism allowing parties to an existing jurisdiction agreement to submit amendments for binding arbitration, with limitations: only one arbitration can occur every 10 years, and amendments cannot apply to qualified parcels. Before initiating arbitration, the initiating party must consult with and provide written notice to the other party. The changes to plat application jurisdiction would only apply to applications filed after the amendment or arbitration decision. The bill takes effect immediately if it receives a two-thirds vote in the legislature, otherwise it becomes effective September 1, 2025.
