Bill Summary

AN ACT relating to the creation and dissolution of a covenant marriage.

AI Summary

This bill establishes a framework for covenant marriages in Texas, providing couples with an option to enter into a more committed marriage with additional legal requirements. Specifically, couples can choose to enter into a covenant marriage either when initially getting married or by designating an existing marriage as a covenant marriage. To do so, they must complete at least five hours of premarital counseling from a clergy member or licensed counselor, who will discuss important personal issues, the seriousness of the marital commitment, and the expectation of working through difficulties. The bill requires couples to file a notarized affidavit stating their understanding that a covenant marriage is a lifelong commitment and that they will make reasonable efforts to preserve their marriage. For couples seeking divorce in a covenant marriage, they must first undergo at least five hours of counseling in an attempt to reconcile. The bill also includes administrative provisions, such as requiring marriage licenses to indicate whether they are for a covenant or noncovenant marriage, and exempting covenant marriage licenses from fees. County clerks will be responsible for processing these special marriage designations, and the attorney general will develop educational materials to help them understand the new requirements. The provisions of this bill will take effect on September 1, 2025.
