This bill expands eligibility for nondisclosure of criminal history record information for individuals who successfully complete specialty court programs. The legislation broadens the existing law by replacing specific references to "veterans treatment" courts with the more inclusive term "specialty" courts, which means the nondisclosure provisions will now apply to a wider range of specialized court programs. Under the new provisions, participants can petition for an order preventing criminal justice agencies from publicly disclosing their criminal history related to the original offense, provided they meet certain conditions: they have not been previously convicted of certain serious offenses, have not been convicted of a felony within two years of program completion, and file the petition at least two years after successfully completing the program. The bill specifically excludes individuals whose program entry was related to intoxicated motor vehicle offenses. Additionally, the bill requires specialty court programs to inform participants about their right to petition for nondisclosure and will take effect on September 1, 2025.
