This bill establishes new requirements for municipalities and counties in Texas regarding emergency repairs to residential buildings. Specifically, local governments must allow property owners to immediately begin repairs that are necessary to protect public safety, prevent further damage, or maintain the structural integrity of a building, provided the repairs are not considered new construction or substantial improvements as defined by federal regulations. Property owners must apply for an emergency permit within three business days of starting repairs or when the local government can accept the application. The bill clarifies that these provisions do not prevent local governments from conducting code inspections or exempt owners from complying with existing health and safety regulations. Importantly, the bill prevents the governor from suspending these requirements through executive order and provides property owners with the right to sue a municipality or county that improperly prevents emergency repairs, including the ability to recover damages, attorney's fees, and litigation costs. The bill will take effect immediately if it receives a two-thirds vote in the Texas Legislature, or on September 1, 2025, if it does not receive the required immediate-effect vote.
