This bill limits municipal authority to regulate the number of dwellings on residential lots by establishing new restrictions on zoning changes and dwelling construction. Specifically, for lots that were zoned for single-family dwellings as of September 1, 2023, and are located in a subdivision with at least one developed lot, municipalities are prohibited from adopting ordinances or regulations that would allow more than one single-family dwelling on such a lot. However, a municipality can override these restrictions if it sends written notice to property owners within 200 feet of the affected properties and obtains written consent (via affidavit) from each of those owners. The bill also amends the Civil Practice and Remedies Code to ensure that individuals or trade associations have legal standing to challenge municipal ordinances that violate these new restrictions. The act will take effect immediately if it receives a two-thirds vote in the Texas Legislature, or otherwise will become effective on September 1, 2025, potentially impacting local zoning decisions and residential development in Texas municipalities.
