This bill amends the Texas Health and Safety Code to require the Texas Commission on Environmental Quality (TCEQ) to consider cumulative air contaminant emissions when evaluating permits for industrial facilities. Specifically, when reviewing permit applications or renewals, the commission must now assess the combined environmental impact of emissions from a proposed facility and other facilities located within three miles. This means that when determining whether to issue or renew a preconstruction permit, the TCEQ must examine not just the individual facility's emissions, but also how those emissions interact with and potentially compound the air quality effects from nearby industrial sites. The changes will apply to permit applications filed with the TCEQ on or after September 1, 2025, aiming to provide a more comprehensive approach to evaluating potential environmental and public health risks from industrial air emissions by looking at the broader contextual impact of multiple emission sources in close proximity.
