This bill addresses the misuse of funds by open-enrollment charter schools in Texas by establishing new restrictions and penalties for spending money on out-of-state schools. Specifically, the bill prohibits charter holders from spending money received for a Texas open-enrollment charter school to support a school located outside of Texas, with an exception for contracts providing goods or services to the charter school. If the Commissioner of Education determines that a charter holder has violated this provision, they are required to withhold an amount equal to three times the money spent in violation from the charter holder's funding for that school year and may adjust future funding to recover any remaining amount. Additionally, the bill amends existing law to include a new grounds for charter revocation: if a charter holder spends at least $100,000 in violation of the new section restricting out-of-state school spending. The provisions of this bill will take effect on September 1, 2025, providing charter schools time to adjust to the new financial regulations.
