Bill Summary

AN ACT relating to the enforcement within this state of certain federal laws for federally declared public health emergencies.

AI Summary

This bill establishes new regulations for how Texas state and local governments can respond to federal public health emergency declarations. Specifically, it prohibits state agencies, political subdivisions, and law enforcement from enforcing or assisting in the enforcement of federal statutes, orders, rules, or regulations related to a federally declared public health emergency that impose restrictions not already existing under Texas state law. If a political subdivision is found to be enforcing such federal regulations, it becomes ineligible to receive state funding, including general revenue funds and state grants. The bill allows individuals to file complaints with the Texas Attorney General if they believe a local government is assisting in enforcing prohibited federal regulations. If the Attorney General determines a complaint is valid, they can seek legal action to compel compliance, and can recover associated legal expenses. The Attorney General is also required to defend state agencies or political subdivisions in any federal actions resulting from compliance with this law. A "federally declared public health emergency" is specifically defined as an emergency declared by the U.S. Secretary of Health and Human Services or the President under specific federal acts. The bill would take effect immediately if it receives a two-thirds vote in the Texas Legislature, or otherwise on September 1, 2025.
