This bill modifies the child health plan (CHP) in Texas to address contraceptive coverage and consent requirements. Specifically, the bill mandates that the CHP provide coverage for FDA-approved prescription contraceptive drugs, supplies, and devices, while explicitly prohibiting coverage for abortifacients or drugs that terminate pregnancies. For enrolled children under 18 years old, the bill requires written consent from a parent, guardian, managing conservator, another authorized adult, or in some cases the child themselves before prescribing or dispensing contraceptive medications. The executive commissioner is restricted from modifying the plan to include reproductive services beyond prenatal care and care related to reproductive system diseases, with the new contraceptive provisions being an exception to this general rule. The bill includes a provision allowing state agencies to request federal waivers if needed for implementation and will take effect immediately if it receives a two-thirds vote in the Texas Legislature, or on September 1, 2025, if it does not receive the required immediate-effect vote.
