This bill amends Section 38.078(d) of the Texas Utilities Code to expand the criteria used by the Public Utility Commission when reviewing electric utility reliability plans. Specifically, the bill adds a new requirement that the commission must consider the extent to which a utility's plan is expected to enhance service reliability for vulnerable customers, including elderly persons and individuals with disabilities. This new consideration will be added alongside existing factors such as system resiliency and the estimated costs of implementing proposed measures. The bill would take effect immediately if it receives a two-thirds vote in both legislative chambers, or otherwise will become effective on September 1, 2025. By explicitly including vulnerable populations in the planning review process, the bill aims to ensure that electric utilities prioritize service reliability for those who may be most at risk during power disruptions, such as seniors and people with disabilities who might have greater challenges during electrical outages.
