Bill Summary

AN ACT relating to the time for processing a municipal building permit application.

AI Summary

This bill modifies the local government code regarding municipal building permit application processing times, specifically requiring municipalities to either grant or deny a permit within 45 days of submission, provide a written explanation for delays, or reach a written agreement with the applicant about a permit deadline. For commercial building permits specifically, municipalities must either grant/deny the permit, provide a written explanation for why they cannot do so, or reach a written agreement with the applicant. If a municipality fails to comply with these requirements, they cannot collect permit fees and must refund any fees already collected. The bill also prohibits municipalities from denying a permit solely because they cannot meet the time requirements or from requiring applicants to waive these requirements. The term "commercial" is defined by a separate section of code. These changes will apply only to permit applications submitted on or after the effective date of September 1, 2025, with previous applications continuing to be governed by the existing law at the time of their submission.
