This bill adds a new provision to Texas state law that requires the Texas Commission on Environmental Quality (TCEQ) to obtain local government approval before issuing air quality permits for concrete crushing facilities or concrete plants in specific urban areas. Specifically, the bill applies to facilities located in municipalities with over 2 million people that lack zoning regulations, or in unincorporated areas of counties with over 4.5 million residents. Under the new law, the TCEQ must send a copy of the permit application to the local governing body and wait at least 30 days before issuing the permit. If the local governing body rejects the application within that 30-day period, the TCEQ cannot issue the permit. The bill does not apply to applications for standard permits, and it will only affect permit applications filed on or after September 1, 2025. This legislation appears designed to give local governments more control over industrial facilities in densely populated urban areas, particularly in regions like Harris County (Houston) and surrounding areas.
