This bill modifies Texas local government and water code provisions regarding county subdivision regulations, specifically addressing when counties can require land subdivision platting. The bill clarifies that counties cannot mandate plat preparation for land divisions outside municipal limits under two key scenarios: first, when the land is primarily for agricultural, wildlife management, ranch, or timber production purposes, and the owner is not creating public use spaces like streets or parks; and second, when all subdivision lots are larger than 10 acres and the owner is not creating public use spaces. Additionally, the bill allows county commissioners courts in priority groundwater management areas to adopt water availability requirements during platting, even if those requirements might otherwise be restricted, to prevent water usage from exceeding the area's safe sustainable yield. These changes aim to provide more flexibility for landowners in rural areas while preserving counties' abilities to manage land development and water resources. The bill is set to take effect on September 1, 2025.
