This bill modifies Texas labor law to strengthen workers' compensation insurance requirements for building and construction contractors and subcontractors. Specifically, the bill mandates that contractors must provide workers' compensation insurance coverage for all of their employees, and subcontractors must do the same for their employees. When a governmental entity enters into a building or construction contract, they must now require the contractor to certify in writing that they provide workers' compensation coverage for their employees. Additionally, if the contractor uses subcontractors, the governmental entity must obtain written certificates from each subcontractor confirming their employees' coverage. The bill expands the methods by which contractors can provide coverage, including through group plans and owner-controlled consolidated insurance programs. Contractors and subcontractors must ensure their insurance coverage is satisfactory to the governmental entity's governing body. These new requirements will apply only to building and construction contracts entered into on or after September 1, 2025, with existing contracts remaining under the previous law.
