This bill expands the definition of "facility" to include a wide range of health care facilities such as various types of hospitals (general, special, mental, crisis stabilization, rural), abortion facilities, ambulatory surgical centers, birthing centers, chemical dependency treatment facilities, end stage renal disease facilities, freestanding emergency medical care facilities, narcotic drug treatment programs, and special care facilities. The bill limits the applicability of these disclosure requirements to facilities with a total gross revenue of $10 million or more. It modifies the administrative penalties for facilities that fail to comply with disclosure requirements, establishing a tiered penalty structure based on total gross revenue: $100 for facilities with revenue between $10 million and $100 million, and $1,000 for facilities with revenue of $100 million or more. The bill provides a lengthy transition period, stating that health care facilities are not required to disclose billing information until August 31, 2029. Additionally, the bill specifies that violations occurring before the effective date will be governed by the previous law. The act will take effect immediately if it receives a two-thirds vote in both legislative houses, otherwise it will take effect on September 1, 2025.
