This bill, the Health Marketplace for All Act of 2024, amends the Employee Retirement Income Security Act (ERISA) to allow health marketplace pools to be deemed an "employer" for the purposes of offering a group health plan or group health insurance coverage. The bill establishes requirements for these health marketplace pools, including that they must be formed and maintained in good faith for the purpose of forming a risk pool to offer group coverage, and that they cannot discriminate in the coverage they offer based on health status-related factors. The bill also allows these health marketplace pools to offer drug coverage, including over-the-counter drugs, either in combination with other benefits or as the only benefit covered. Additionally, the bill clarifies that participating in or facilitating a group health plan or coverage through a health marketplace pool does not establish an employer relationship or joint employer relationship for any purpose other than offering the group coverage.
