Bill Summary

AN ACT REVISING WORKERS' COMPENSATION LAWS RELATING TO TRANSPORTATION; PROVIDING THAT WHETHER AN EMPLOYER FURNISHES TRANSPORTATION OR THE EMPLOYEE RECEIVES CERTAIN REIMBURSEMENT FROM THE EMPLOYER IS NOT DISPOSITIVE OF WHETHER THE EMPLOYEE IS COVERED FOR WORKERS' COMPENSATION INSURANCE; AMING SECTION 39-71- 407, MCA; AND PROVIDING AN APPLICABILITY DATE.”

AI Summary

This bill revises Montana's workers' compensation laws regarding transportation and employee coverage, specifically focusing on clarifying when an employee is eligible for workers' compensation benefits during travel. The key change is in how transportation and travel reimbursement are interpreted in relation to workers' compensation coverage. Specifically, the bill adds language stating that whether an employer provides transportation or reimburses travel expenses is not the sole determining factor for whether an employee is covered under workers' compensation. Previously, an employee was typically only covered while traveling if the employer furnished transportation or reimbursed travel costs as part of employment benefits and the travel was necessary for the job. The new provision creates more flexibility in interpreting travel-related workers' compensation claims by removing the strict requirement that transportation or reimbursement automatically dictates coverage. The bill will apply to workers' compensation claims for injuries or deaths occurring on or after October 1, 2025, giving employers and insurers time to understand and adapt to the new interpretation of travel-related coverage.
