Bill Summary

AN ACT relating to criminal procedure; authorizing the Administrator of the Division of Public and Behavioral Health of the Department of Health and Human Services to request from a local detention facility access to any records in its possession which contain information that may assist in evaluating and treating a defendant who is committed to the custody of or ordered to report to the Administrator based upon a finding of incompetence; requiring a local detention facility to provide access to any such records for the limited purpose of allowing the Administrator to evaluate and treat the defendant; and providing other matters properly relating thereto.

AI Summary

This bill expands the existing legal provisions that allow the Administrator of the Division of Public and Behavioral Health to request and access records from correctional facilities when evaluating and treating defendants found incompetent. Specifically, the bill now extends these record access rights to local detention facilities (such as county, city, or town jails), in addition to the Department of Corrections. The Administrator or their designee can now request medical, mental health, and other relevant records from local detention facilities for defendants who have previously been detained there and are now committed to the Administrator's custody due to a finding of incompetence. The bill ensures that these records can be accessed without requiring the defendant's consent and clarifies that the purpose of accessing these records is solely for evaluation and treatment. This change allows for more comprehensive medical and mental health information to be available when assessing and treating defendants who have been determined to be incompetent to stand trial, potentially improving their care and rehabilitation process.
