AI Summary
This bill establishes a comprehensive regulatory framework for alternative nicotine and vapor products in Montana, creating new licensing, sales, and age restrictions while separating these products from traditional tobacco regulations. The bill defines alternative nicotine products and vapor products, requires retailers to obtain a $20 annual license from the Department of Revenue to sell these products, and prohibits sales to individuals under 18 years of age. Retailers must display age restriction signs and can only sell these products in age-restricted venues, with specific rules for vending machine sales that limit them to locations like bars with direct supervision. The legislation introduces a graduated penalty system for violations, starting with verbal warnings and escalating to potential license suspension for repeated offenses. Minors assisting in enforcement are protected from legal liability, and local governments are allowed to adopt regulations that are not more stringent than the state law. The bill also amends multiple existing statutes to integrate these new regulations and repeals a previous section of law related to local ordinances on alternative nicotine and vapor products. The bill's context suggests it is a response to potential changes in federal regulatory approaches, aiming to create a clear state-level framework for these products.
