This bill revises the rules for filing postconviction petitions for writs of habeas corpus (legal requests to challenge imprisonment) by changing where and when such petitions can be filed. Under the new law, petitioners must file their petitions with the clerk of the district court based on their current incarceration or residence status: if currently incarcerated in Nevada, they file in the county where they are imprisoned; if released from the Nevada Department of Corrections and residing in Nevada, they file in their county of residence; and if incarcerated or residing outside of Nevada, they file with the First Judicial District Court in Carson City. The bill also maintains existing provisions that prevent petitioners from challenging both the validity of their conviction and the computation of time served in the same petition, requiring courts to resolve conviction challenges and dismiss time computation challenges separately. These changes will apply only to petitions filed after the bill's effective date, ensuring that existing petitions are not retroactively impacted by the new filing requirements.
