This bill introduces new safety requirements for portable generators in Texas, mandating that manufacturers and retailers place warning labels on generators and their packaging if the device does not have a carbon-monoxide kill switch installed. The warning labels, to be specified by the commissioner of insurance, must notify consumers about the risk of carbon monoxide poisoning and provide guidance on safe generator operation. If a manufacturer or retailer fails to comply with these labeling requirements, they can be held liable in a civil action for personal injuries, deaths, or other damages caused by the violation. Successful plaintiffs would be entitled to injunctive relief, actual damages, court costs, and attorney's fees. Additionally, violations of the labeling requirements are considered deceptive trade practices, which can be enforced by the consumer protection division of the attorney general's office. The law will take effect on September 1, 2025, and will apply only to causes of action that accrue on or after that date, giving manufacturers and retailers time to update their products and practices to comply with the new safety regulations.
