This bill amends the Public Health Code to prevent the state from disciplining or denying licensure to individuals who were previously disciplined in another state for conduct that is legally protected under the Michigan Constitution or considered a "legally protected health activity" as defined in the Revised Judicature Act. The key provisions of the bill are: (1) a disciplinary subcommittee cannot impose sanctions on a licensee, registrant, or applicant for conduct that was prohibited in another state but protected in Michigan; and (2) a board, task force, or the Department cannot deny an application for licensure or registration based on such conduct in another state. The bill will not take effect unless Senate Bill No. 1152 is also enacted into law.
