Bill Summary

AN ACT GENERALLY REVISING LAWS REGARDING DISCRIMINATORY PRACTICES IN EDUCATION; PROVIDING THAT IT IS AN UNLAWFUL DISCRIMINATORY PRACTICE FOR AN EDUCATIONAL INSTITUTION TO ALLOW A MALE PERSON TO PARTICIPATE IN ATHLETIC PROGRAMS DESIGNATED FOR FEMALE PERSONS; PROVIDING THAT IT IS AN UNLAWFUL DISCRIMINATORY PRACTICE FOR AN EDUCATIONAL INSTITUTION TO FAIL TO PROVIDE A PERSON WITH ACCESS TO A RESTROOM, LOCKER ROOM, SHOWER AREA, OR SLEEPING QUARTER THAT IS INACCESSIBLE BY A PERSON OF THE OPPOSITE SEX WHILE IN USE; PROVIDING EXCEPTIONS; AND AMING SECTION 49-2-307, MCA.”

AI Summary

This bill proposes significant changes to Montana's anti-discrimination laws in educational settings by establishing new restrictions related to gender and sex. Specifically, the bill amends existing law to make it an unlawful discriminatory practice for educational institutions to allow individuals whose sex is male to participate in athletic programs designated for females, and to prevent educational institutions from permitting individuals to access restrooms, locker rooms, shower areas, or sleeping quarters designated for the opposite sex while in use. The bill does create some exceptions, such as allowing access for custodial, maintenance, or medical assistance purposes, and during emergencies. Additionally, the bill permits educational institutions to establish single-occupancy facilities or redesignate multi-occupancy spaces. The legislation maintains previous protections against discrimination based on characteristics like race, religion, age, and disability, while introducing these new provisions specifically addressing sex and gender-related access. The bill includes a severability clause, which means that if any part of the act is found invalid, the remaining valid parts will still remain in effect.
