This bill amends California law regarding Accessory Dwelling Unit (ADU) ordinances by establishing stricter compliance requirements for local agencies. Specifically, the bill requires local agencies to submit their ADU ordinances to the Department of Housing and Community Development (HCD) within 60 days of adoption. If HCD finds that an ordinance does not comply with state standards, the local agency must either amend the ordinance or adopt a resolution explaining why they believe the ordinance meets state requirements. If the local agency fails to submit the ordinance within 60 days or does not respond to HCD's findings within 30 days, the ordinance will be automatically invalidated, and the local agency must then apply state-established ADU approval standards. This legislation aims to ensure that local ADU ordinances align with state housing laws and provide a clear mechanism for enforcing compliance, ultimately facilitating the creation of additional housing units at the local level.
