This bill expands the legal authority of parents, guardians, and conservators to enter into settlement agreements on behalf of minors without prior court approval. The legislation increases the monetary threshold for such settlements from $3,000 to $25,000, allowing parents to settle claims more easily for their children. Specifically, parents can now make settlement agreements without court intervention if: the minor is not emancipated, no prior guardian has been appointed, the total settlement is under $25,000, and the funds are paid directly to the parent or into a trust for the minor's benefit. The bill requires the parent or guardian to make a reasonable inquiry into the claim and attest that the settlement either fully compensates the minor or represents the best possible recovery. Importantly, the bill also provides a legal cause of action for minors against parents or guardians who mismanage settlement funds or fail to comply with the law's requirements. The new provisions will take effect on July 1, 2025, and apply only to settlements entered into on or after that date, providing greater flexibility for managing minor settlements while maintaining protections for the child's interests.
